Terms of Service

1. Acceptance of these terms

These Terms of Service (the "Terms") are an agreement between you and despawn ("we", "us" or "our"), the publisher of the AllWays app ("AllWays" or the "app"). By downloading, accessing or using AllWays, you agree to be bound by these Terms. If you do not agree, do not use the app.

2. Eligibility

You must be old enough to form a binding contract in your country to use AllWays, and at least 13 years old, or older where required by local law. By using the app, you confirm that you meet these requirements.

3. License to use the app

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable and revocable license to download and use AllWays on Apple devices that you own or control, for your own personal, non-commercial use. You may not copy, modify, distribute, sell, lease, reverse engineer or attempt to extract the source code of the app, except where the law expressly permits it.

4. Accounts and guest mode

You can use AllWays in guest mode without creating an account. If you create an account, using email, Sign in with Apple or Sign in with Google, you are responsible for the activity that happens under your account and for keeping your sign-in method secure. You agree to provide accurate information and to let us know if you believe your account has been compromised.

5. Subscriptions and billing

AllWays offers an optional paid subscription, Travel+. Travel+ is sold and billed through the Apple App Store and managed through your Apple ID. It is an auto-renewing subscription. Unless you cancel, it renews automatically at the end of each billing period, and your Apple ID is charged for the renewal.

You can manage or cancel your subscription at any time in your Apple account settings: open Settings on your device, tap your name, then tap Subscriptions. Cancellation takes effect at the end of the current billing period. Any free trial that may be offered will convert to a paid subscription unless you cancel before the trial ends, and any unused portion of a free trial is forfeited if you purchase a subscription during it.

Because billing is handled by Apple, Apple's standard end-user license agreement and refund policy apply to your purchase. Refund requests are handled by Apple in accordance with that policy. We do not process payments and do not receive or store your payment details. For details, see our Refund Policy.

6. Your content

The trips, itineraries, expenses, documents and notes you add to AllWays are yours. This content is stored on your device, not on our servers, and you are responsible for it. We do not claim ownership of your content. Because your content lives on your device, keeping your own backups, for example through your device backup, is your responsibility.

7. Acceptable use

You agree not to use AllWays to:

• break any law or infringe anyone's rights;
• interfere with, disrupt or attempt to gain unauthorized access to the app, our systems or our service providers;
• misuse, overload or circumvent any security or anti-abuse measures, including App Attest;
• use the app for any unlawful, harmful or fraudulent purpose.

8. Intellectual property

AllWays, including its software, design, branding, logos and name, is owned by despawn and is protected by intellectual property laws. These Terms do not grant you any rights in our trademarks or branding. All rights not expressly granted to you are reserved.

9. Third-party services and content

AllWays uses third-party services to provide certain features, including weather, maps, geocoding, routing, place information, images and flight details. The data these services provide is supplied by those third parties and is made available to you "as is". We do not control and are not responsible for the accuracy, availability or content of third-party services, and your use of them may be subject to their own terms.

10. Travel information disclaimer

AllWays is a planning tool. Travel information shown in the app, including schedules, routes, weather, place details and flight status, may be incomplete, out of date or inaccurate. Always verify important details, such as departure times, gates and bookings, directly with the relevant airline, operator or provider before you rely on them. We are not responsible for missed connections, bookings or other losses that result from relying on information in the app.

11. Disclaimers

AllWays is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted, error-free or secure, or that any defects will be corrected. Your use of the app is at your own risk, to the extent permitted by law.

12. Limitation of liability

To the maximum extent permitted by law, despawn and its providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue, or goodwill, arising out of or related to your use of, or inability to use, AllWays. To the maximum extent permitted by law, our total liability for any claim relating to the app will not exceed the amount you paid us, if any, for the app in the twelve months before the claim arose.

13. Indemnity

You agree to indemnify and hold harmless despawn and its providers from any claims, damages, liabilities and expenses, including reasonable legal fees, arising out of your misuse of the app, your violation of these Terms, or your violation of any law or the rights of any third party.

14. Termination

You may stop using AllWays at any time and may delete your account from within the app, as described in our Privacy Policy. We may suspend or terminate your access if you breach these Terms or misuse the app. Sections that by their nature should survive termination, including ownership, disclaimers, limitation of liability and indemnity, will continue to apply.

15. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Your continued use of AllWays after changes take effect means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of Armenia, without regard to its conflict of law rules, except where mandatory local consumer protection laws give you additional rights.

17. Apple App Store terms

AllWays is distributed through the Apple App Store. The following applies to your use of the app on Apple devices. These Terms are between you and despawn only, not with Apple, and Apple is not responsible for the app or its content. Your license to use AllWays is limited to a non-transferable license to use it on Apple-branded devices that you own or control, as set out in Apple's standard Licensed Application End User License Agreement. Apple has no obligation to provide maintenance or support for the app. In the event the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Apple is not responsible for addressing any claims relating to the app, including product liability, legal or regulatory claims, or intellectual property claims. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce these Terms against you.
